关于外国专利代理机构在京设立常驻代表机构的政策推介函（Letter of Policy Introduction for Foreign Patent Agency to Set-up Permanent Representative Office in Beijing）
各外国专利代理机构：
为进一步推进我市知识产权服务业领域扩大对外开放，引入国际高水平知识产权服务资源，国家知识产权局批复同意在北京开展专利代理对外开放试点工作，允许外国专利代理机构在华设立常驻代表机构。现将有关政策函告如下：
一、外国专利代理机构申请设立常驻代表机构、派驻代表，应当具备以下条件：
(一)该外国专利代理机构已在其本国合法执业，并且没有因执业行为受过自律惩戒或者行政处罚;
(二)代表机构的首席代表、代表应当具有专利代理资格，并且已在中国境外专利代理执业不少于2年，没有因执业行为受过自律惩戒或者行政处罚;
(三)该外国专利代理机构已在其本国有10名以上专利代理师执业。
二、外国专利代理机构申请设立的常驻代表机构、派驻代表可以依法从事下列业务活动：
(一)向当事人提供该外国专利代理机构已获准从事专利代理业务国家或者地区的专利事务咨询;
(二)接受当事人或者中国专利代理机构的委托，办理在该外国专利代理机构已获准从事专利代理业务国家或者地区的专利事务;
(三)知识产权培训服务;
(四)知识产权许可、转让服务;
(五)接受当事人或者中国专利代理机构的委托，为我市企业海外投资、海外预警、海外维权等活动提供专业化服务;
(六)代表外国当事人，委托中国专利代理机构办理中国专利事务。
代表机构及其代表应当依法开展业务活动，不得从事代理专利申请和宣告专利权无效等中国专利事务以及中国法律事务。
三、外国专利代理机构在华设立常驻代表机构，应当在企业登记管理部门办理登记手续，并经国家知识产权局批准，提交的文件材料包括：
(一)该外国专利代理机构主要负责人签署的设立常驻代表机构的申请书;
(二)该外国专利代理机构给代表机构拟任首席代表、代表的授权书，该授权书中应当明确代表机构、代表的业务范围;
(三)国家知识产权局要求提交的其他材料。

Letter of Policy Introduction for Foreign Patent Agency to Set-up Permanent Representative Office in Beijing
Foreign Patent Agencies:
In order to promote the opening up of the intellectual property service industry and attract high-level international intellectual property service resources in Beijing, China National Intellectual Property Administration(CNIPA) approved the pilot work of patent agency opening to the world in Beijing, allowing foreign patent agency to set up permanent representative office in China. The policy is as follows:
1. The foreign patent agency who apply for the setting-up of a permanent representative office or sent representatives, shall meet the following conditions:
1) The foreign patent agency has already legally practiced in its own country and has not discipline punishment or administrative punishment record;
2) The chief representative or representatives of the representative office shall have the patent agency qualification, and have practiced patent agency outside China for not less than 2 years, and have not discipline punishment or administrative punishment record;
3) The foreign patent agency has more than 10 patent attorneys practicing in its own country.
2. The permanent representative office and representatives set up by foreign patent agency can abide by the law to do the following business:
1) To provide patent consultant business which the foreign agency was permitted to do in the country or region;
2) To accept the authorization of the people or the Chinese patent agency, to provide the patent agency business which the foreign patent agency was permitted to do in the country or region;
3) IP training service;
4) IP licensing and transferring service;
5) To accept the commission of the people and the patent agency of China, to provide professional services for the overseas investment, early warning, rights protection and other activities for the enterprises in Beijing;
6) To on behalf of foreign parties, entrust Chinese patent agency to solve Chinese patent affairs.
The representative office and representatives shall legally operate business, and shall not be engaged in China's patent affairs and China's legal affairs, such as agent patent application and invalidation of patent right.
3. To establish a permanent representative office in China, the foreign patent agency shall register in the administration department for enterprise registration, and obtain the approval of the China National Intellectual Property Administration(CNIPA). The submitted documents include:
1) The application for the setting up of permanent representative office signed by the person-in-charge of the foreign patent agency;
2) The letter of authorization proposed by the foreign patent agency to be the chief representative or representatives of the representative office shall specify the business scope of the representative office or representatives;
3) Other documents required by the China National Intellectual Property Administration(CNIPA).
